I own a small WB that is the original house on a block that has two units behind. We have a shared driveway and a single garage at the rear of our house. Banyule council are telling me that because im adding a third bedroom to the house that I need a second car space on the block...(.I wish they had told me this when I brought my mud drawings in.) Anyway Banyule planning have told me that I may not have enough private open space to propose a second car space on the block in the backyard. Can anyone give me any simple idea's about how to work this out or point me in the direction of someone who will be able to work this all out. Re: Banyule council prob with application for planning permi 2May 05, 2011 2:03 pm First of all find out how much private open space there is currently available to that building, then subtract 18mq (1 car space is depicted as 3m wide x 6m long) and then work out what area you need. If for instance you had an area of 8m x 5.5m as your "private open space" (this is an area used for recreation that is not a pathway or thoroughfare, has no sheds/buildings over it and is not used primarily for storage but can be a covered deck/pergola) and you were required to have a minimum area of 5mx5m or equivalent area (25m2) you could put a 6x3 car space there as you would have 26m2 left as your "private open space" However if your yard was 8m x 5.0m you would only be left with 22m2. You need to find out what the required open space is and then measure the property and submit a drawn plan (your draftsman can do this easier than you can) with meterage and percentages shown Re: Banyule council prob with application for planning permi 3May 05, 2011 10:54 pm Thanks for your response chrisandkate, Have found out that max site coverage is 60%, so assuming that means minimum private open space is the other 40%? (I will confirm this) Based on this my calc's are as follows: Max site Coverage:60% of 324 sqm = 194.4sqm. leaves 129.6sqm private open space Site size: 324sqm Existing Residence 86.80 sqm (Hence the need for the extension) Double car space 33.00 sqm ( 6x5.5) Exten 39.50 sqm Total site coverage = 173.6 sqm 194.4-173.6= 20.8 sqm UP MY SLEAVE IN EXTRA PRIVATE OPEN SPACE ......err yep! It won't be a percentage but a length by width measurement that translates to a measurable area. A similar situation, in my council you cannot build a house/unit/residence on a block smaller than 300m2 and you must have a minimum of 20% of the block size or 80m2 whichever is smaller (obv in this case it is 20% @ 60m2) I found the link to the regulation setout in the building res http://www.austlii.edu.au/au/legis/vic/ ... /s421.html It states "Building Regulations 2006 - SECT 421 Private open space 421. Private open space (1) If- (a) an allotment is in a zone of a planning scheme specified in Schedule 5; and (b) the Schedule to that zone in the planning scheme specifies a minimum area and dimension for private open space- a Class 1 building on that allotment must have private open space of at least the area and dimension specified in the Schedule to that zone in the planning scheme. (2) If subregulation (1) does not apply, a Class 1 building on an allotment must have private open space of not less than 80m2 or 20% of the area of the allotment, whichever is the lesser. (3) For the purposes of this regulation, the private open space must include an area at the side or rear of the building- (a) that is at least 25m2 with a minimum dimension of 3m; and (b) that has convenient access from a habitable room (other than a bedroom). (4) The report and consent of the relevant council must be obtained to an application for a building permit in relation to a design that does not comply with this regulation. Division 3-Siting of Class 10a buildings" Just to sort out one thing. Private open space IS NOT the balance of the site after deducting site coverage of the house. Also you mention a double car space. Does this mean you have a double already? and they are asking you to put in another one? In any case When "I" read the regulations my understanding is that because your property is not in the Bayside, Glen Eira, Kingston, Knox, Manningham, Maroondah or Monash Planning schemes, you are required to have a minimum of 64.8m2 of private open space to the rear and or side of the dwelling. If you have a large set back this may hinder your design also. From my (possibly misguided) calculations you will require an area of no less than 64.8m2 to the rear and or side of your dwelling once the extension and extra car space have been completed with either the length or width of the area being a minimum of 3m. My advice would be get a drafts person to draw it up and whoever does the permit ill work out whether you have enough room left or not pretty quickly. I have today talked to planning and discovered that I need 40sqm minimum in front yard. Tick ive got 88sqm. Now the tricky part I need 25 sqm seculded private space (back/side yard. I only have a single garage. I have a 3m x 6m Carport now that will need to be widened to 5.5m wide by 4.9m long for second car. Anyone know if I can use the 1m wide x 14 m long side of my house as seculded open space? FWIW I wouldn't think it'd be good enough as its kind of against the grain of the idea of private open space. Then go to planning and building regulations. If you read through those it will give you all the info you want Or, as someone suggested, get your plans drafted.
