I have read all the info about contracts from Vic building commission site but still unsure about how -as an OB-to do a contract for just the labour component using a builder that is registered . He will do a few stages of the build : slab, frame ,windows and other jobs a carpenter would do. I am providing all materials.
We have conflicting advice suchas:
He has to register the whole job there fore have warranty insurance -MBA
He doesn't need the insurance as I the OB have to if we sell within the prescribed time-his insurance provider
A contract with him has set stages of payment that we have to follow-Major building contract requirements
His building trade mates"we don't worry about all that-just do the work and get paid what you have agreed on"
We are going round and round trying to solve this and keep within the law as the penalties are significant AND avoid doubling up on warranty insurance if we dont have to.
Btw this builder is a long time friend and completely reliable and has done bits and pieces for me fo 30 odd years so the argument that a contract is for our protection irrelevent in his case.
Please help!
