Browse Forums Owner Builder Forum 1 Apr 17, 2012 12:01 pm Hey everyone newbie here My husband and I are currently doing our first owner build, it has been very stressfull combining it with planning our destination wedding Any way we are currently at lock up, slab was poured at Christmas. Feels like its taking forever but it hasn't been THAT long. Just relying on my FIL to finish the roof was quite tough. I have a question, does anyone know how the sub division titles work? Our current project is a sub division. We completely renovated the existing house and are building on the back of our 716 sq block. Both the houses/titles are in my husbands name. What I am asking is that the next place we are hoping to buy futhur in toward the city ie Parkdale/Mentone area, and to increase buying potential along with the current equity, buy the next place in a joint name. I am wondering is it possible to sub divide the block from the start, and put the title of the back of land in MY name so that I can do the next owner build, so we don;t have to wait 3 years? Our land surveyor seems to think its OK but said to confirm it legally with conveyancer? It used to be 12 months and only have to be your primary residence but that changed some time ago. That is the way I understand it applies in Victoria. Unless there is a loophole, your next build will be three years after your have completion of this one. Next is the stack stone cladding on the front and hanging the doors, going for a deep red front door. Re: First owner build project- SE suburbs 8Apr 20, 2012 8:46 pm I think the reasoning behind it is that regardless whether or not it is in your name you still "enjoy" the the aspects of the project. ie It would be very hard to say that you have not taken any part whatsoever in the build process. If you take any part in the build you also have been involved as part of the owner build, and probably should have been listed in the owner build application to the Building Commission. Coz listed or not you still are part of it. Like it or not that's how I believe it is done now. The only way I am aware around this is to complete the relevant courses and register as a builder, which these days is a fairly onerous, and expensive process unlike a few years ago when almost anyone could register.
