Though some builders might reduce/waive the fee, depending. Here they wouldn't let you do it as we are in a heritage overlay and they care very much about what type of window you use. It would mean resubmitting the plans for approval. Speaking purely from a Vic perspective, once a 'Thermal Assessment' has been provided as a part of the Building Application documentation, the window type cannot be altered. Although altering a window from double hung to awning may seem insignificant, it may have a bearing on the input to the rating software & in a situation where the home is borderline it is possible a small variation could reduce the rating to below the required statutory level. In a 'perfect world' the building inspector should pick up on a discrepancy between the nominated windows in the rating & installed products. I have no idea of the Basix procedure in NSW but post this as general information. I don't think I specified the window opening type. I'm going to check now that I've said that. Have you anonymously called your council to do the research?
