If it is that I have 'proof' that the OB didn't live here, I would have thought the woman I spoke to at BC would have known that I would have access to this information (permits and surveyor sign offs and what not - not that she asked), but basically she insisted that it would be extremely difficult matter to prosecute and she didn't sound like they would be interested in even looking at it. My point being that if any were listed, then we are deemed to have taken those defects on when we purchase the house. If no defects are listed, but we find some, we can still claim to have them rectified. As Bingo Shelley pointed out, some will fix, others will refuse, some matters will end up in court. We are hoping he will fix our problem without us having to go to VCAT - but we shall see. I don't think I know all the correct terms and names of everything... but, we got a certificate of final inspection, an OB insurance report (that lists any fault/defects), and we got OB insurance warranty certificate (don't have that in front of me so not sure of the correct name for it). I can't remember all your current defects (I know they are not trivial), but not all defects can be found at the time of the defect inspection. So, I believe that the builder would be liable to fix any structural defects within the 6.5 or so years. My signature is distracting people from my wise posts ... Re: A question re OB selling property.... 23Jun 21, 2011 2:31 pm i think trying to prove they didnt live there for the required time if any dosnt really help you get your house fixed all its going to do is make the obers dig their heals in and say stuff you take me to court. as much as revenge is sweet and all its also very costly you need to approach the previous owners in a more technical sense let them know youve contacted the bca and that the repairs need to done asap or the bca will take them to court. keep in mind these people may well be looking at this thread and know exactly what your up to and what your doing giving them the edge over you. we have all seen aca programs showing peoples houses being demolished because of ** workmanship and they have lost 10s of 1000s trying to prove their case in court only to become bankrupt themselves and losing everything so keep in mind the cost of revenge can out weigh the cost of a life lesson stay safe happy building Re: A question re OB selling property.... 24Jun 21, 2011 2:51 pm Lex How Hard Can it Be Well there wasn't any defects listed. And we wouldn't have done anything with regards this until we had our ensuite fixed. Yes, it had occurred to me they could be reading this. And, we wouldn't take this matter on if it was going to cost us heaps. We don't want to spend much more energy on it actually. We just want our house fixed. And if, along the way, we could have 'dobbed them in' and let someone else who was interested take up the matter (ie, the building commission) then so be it. But it looks like they couldn't give a stuff so not sure why they bother with the guidelines to begin with. Thanks everyone.
