We have have approx 2.4 metre drop over our building site.
Just received a letter from council regarding the cut & fill variation we would like to the D.C.P to enable us to build the house we want, it seems that they wont allow us to fill, Our proposal was to have 1 metre cut, 1 metre fill battered out to natural ground with a 400mm deep edge beam but they have come back and said we can cut 1metre and have a 1.4 deep edge beam, with no fill to extend beyond the building envelope.
My thoughts, considering we are on 2.5 acres with our nearest neighbour 80 metres away is why not?
I have spoken with my neighbours and they are recommending more fill then cut, so there is no problem there.
We also went into council prior us launching the D.A and showed the on duty planner our plans and she said to extend the fill even further from the house so as we could have a smoother batter?? (her name and the date we went in has been documented).
Based on council's recommendation we would have a larger then normal masonry wall on almost half the house with one whole side of the house having a 1.4m deep edge beam, not exactly a pleasing sight.
Our plans have not been accepted nor rejected yet however we are not comfortable with there proposal and are a little unsure on what process to take e.g. is their legal action we can take (would prefer not to but is there any other option)?
Or is this simply an over reaction on our behalf and should we just accept it and move on?
