"Note: If the development consent is for 'dual occupancy' an owner-builder permit can only be granted in cases of special circumstances otherwise it must be refused." After an hour of trawling the web all I've gathered is saying your family is going to live in the other house is not going to get approved. But no real idea what circumstances they would approve Personally, I am going to have a lumpy cashflow year. So if worst case i have to delay a couple trades for a month it will be a lot easier than having having to delay a large progress payment to a builder and derail things. On top of that, the timing is great for me to be able to do the project next year & I am over living in a tiny fibro shack so want to get started on the project as soon as I can. That's why there are certain rules around what you can build and how often and also around when you can sell the property. The issue has been that people try and use an OB licence in an attempt to become back door developers. Obviously with a duplex you have a second dwelling that many people will attempt to sell. Thus the OB is seen as a developer even if that isn't their intention. Unfortunately there would be many examples where people say it's for family and then turn around and sell it straight away or after a short time as that was always their intention. If you are looking to do it for family members the best way would be to have their names on the title and then they apply for a OB licence for their half and you apply for one for your half. You can project manage the entire build after that and do it all as one, however there will be 2 OB licences for each half, and will have the legal responsibilities shared that way. Usually the applicant for the OB licence has to be the registered owner of the land.
