Browse Forums Building A New House 1 Aug 05, 2020 2:29 pm Hi we are in process of building a house plans are in council and council send it for public notice both neighbours send in their respresentation saying thinks like overshadowing and our house will block their views we had shadow diagrams which did not satisfy them We did survey of our land and found out both neighbours have encroached into our land . Our planning developers says While helpful in respect to providing greater appreciation of the subject land, the encroachment is a civil matter which is unlikely to be given much consideration by the Council. In fact it may complicate matters and might be best addressed with the adjoining property owners outside of the assessment process (and better to be actioned after a consent has been acquired). I suggest obtaining legal opinion also be contemplated prior to bringing it to the attention of the adjoining owners. But thatโs just my opinion. Talk to your solicitor; they should be providing appropriate answers. Yeah I don't know why I came to a forum.
