We are about to settle and there are so many defects that don’t meet minimum building standards. Our developer and builder have parted ways. However, if it's a small developer, they may close the company down. I'd be checking everything with a fine tooth comb and not accepting settlement until everything is perfect, just assume it won't be fixed afterwards. Generally it is up to the entity that you signed the contract to buy the unit from is who is responsible for presenting the unit in an appropriate condition for handover. I would assume that your contract is with the developer so it wll be up to the developer to engage a different builder to complete the works to an appropriate standard. We are trying to stop settlement but as the certificate of occupancy has been issued it’s not easy to do. We are worried that nothing will be fixed once settlement has occurred.
