Browse Forums Building A New House 1 May 27, 2020 7:01 am Hi All, is there a legislation that states excavation done on your land should be supported on your land? We are in the situation where my builder cut our land by 564mm. Our land is small, 300m2, so the cut extends to the fenceline boundary. In the initial plan that went out for review, there was retaining wall In the boundary. This was subsequently removed because there is an easement 900mm wide from the fenceline to the external wall of our house. Our side access is 1.35m wide and easement is 900mm so we only have 450mm to work on. We can’t put the wall on 450mm space as it won’t comply with the 900mm side setback. We also can’t build the wall on the boundary because we have the neighbour’s zero-boundary garage on natural ground level. My understanding there was a negligence on on my builder side for not altering the cut/fill after the retaining walls were removed. I want to press on but I need to quote legislation if there is any. I already went to council to have walls approved but it was rejected. I am hoping it does not get there. So for now, I am just looking for solid legislation I can probably quote to the builder. As of the moment, they kept on telling me that they were compliant and so are not to be blamed. Your builder might just say it’s was a temporary construction measure. That would be compliant. Thats what they keep on saying back to me - it was compliant during the build. They are also saying that the neighbour’s cut was not beneficial for me. Whereas, the neighbour maintained his garage on NGL. Mine was cut but no provision for support. It’s Like we were relying on the neighbours to be able to support our land. Hi all.
