We signed the HIA(VIC) contract with builder on 27 of July 2018. Building contracts says 90 days for the Planning approval and 90 days for Building Permit from the day of signing the contract, and 293 days for the construction including all holiday.
Builder got the Building Permit on 15/8/2019 and builder started the construction on site on 03/10/2019. Last invoice I got for construction on 19/05/2020.
Throughout the process, builder never claimed any time extension. Builder never gave proper reason for delay.
Our house is in new estate and only approval required from the estate before Building permit(Basic exterior color and material approval). No council involvement.
I believe, builder had only 90 days to bring the Building permit.
No delay was happened because of us and the land was titled before signing the contract.
Contract only says " $250 per week for delay damages for late completion of Building works".
I couldn't find damages for getting late building permit approval.
The question is what I can claim? and what is the best process to claim it ?
