During CDC approval stage, they removed a provisioned retaining wall on our side access as there is a 0.9m easement. They have cut 564mm in that zone. At that time, I have contested that design as there is obviously some retainment that needs to be done. However, builder was adamant that most probably I don’t have to retain it and added I can just add a concrete sleeper (not retaining wall) under the fence. The whole situation is scketchy. Fast forward to today, a neighbour’s zero-lot garage was built on the easement boundary. I have a 450mm Ground drop that needs to Be retained. Penrith council maintains that they don’t allow anything built on top of the easement zone no matter what the case maybe. That space is only 1.35m and 0.9m of that is easement. If I build outside of the easement, out side access will be unusable. Could someone please advise me what to do? I am in the verge of resorting to legal options against the builder. I have talked to my structural engineer and the council. As of the moment, there seems to be no satisfactory solution. Re: Retaining wall on the neighbour’s zero lot boundary 2May 09, 2020 6:28 pm I'm not quite sure of the layout but check the CDC restrictions-you might find excavation is not allowed under a CDC-Presumably if the builder puts the wall back as it was originally all is sweet and as per approved CDC? A permanent batter slope in lieu of retention would require probably at least 1m horizontal distance so it sounds like that is not feasible. I thought the maximum slope is 1:2 but I’m not aware there is a minimum 1m horizontal distance. This might actually work for us. But not sure if there’s a required offset from our house to the bottom of the slope? You must be new to the internet.
