Browse Forums Building A New House 1 Apr 07, 2020 9:25 pm hi Guys , So after much deliberation and back and forth with the builder , we are finally going to sign the contract. Although not sure if this is an ideal time to be starting construction. But we decided to bite the bullet anyway . So my question is this : We signed an initial tender but made a few changes and variations down the track. I wanted to make sure we had all pricing upfront before i signed the contract . So we have two variation/change requests that we have signed. However this hasn't been signed by the builder and apparently wont be signed by them. So the HIA they said would be a generic one , with the fixed price build cost . They said that the variation costs wouldn't be included and no reference would be made to this document either. I'm just wondering if this is standard. Once I sign , how can i be sure that they will honor the pricing agreed for the changes . If they back out , how can we hold them accountable ? They said that the change request is legally binding too . but just wondering if this is all standard. This is our first time build so a bit nervous and want to make sure everything goes ok . thanks in advance. Re: HIA agreement help 3Apr 08, 2020 8:38 pm The variations that you signed should be incorporated into the contract tender, anything after this should be a Variation to the contract, as far as I am aware anything prior to the contract does not really exist, unless its in the contract they don't have to do it Hope this helps Re: HIA agreement help 4Apr 08, 2020 10:17 pm Thanks guys . I thought so too. They’ve posted the contract out . I’ll have a look at it once I receive it and check what they’ve included in it . They were quite vague when I asked them about. So it would be interesting to see What’s noted it. I won’t be signing unless the total cost is included . The whole reason I made the changes and waited so long to sign the contract was so that I could get the entire cost upfront . Wondering if anyone else had any similar experiences ..
