Browse Forums Building A New House 1 Feb 02, 2020 9:03 pm Hi Need some advice on rear set back for small lot. I believe brisbane city council setback for small lot code is 6metres to rear. I want to know if 6m setback is counted from the eves or the wall of the house? My house Would be 5.6m from rear boundary if I count eves. It’s just over 6m if counted from wall. I don’t want to lose eves (450mm), so wanted to know if anyone has experienced this issue. There is $4000 relaxation fee which is pretty hefty and can’t afford to pay and I cant reduce actual house size, only options is to get rid of eves at the back. I really don’t want to lose eves at the back. I will appreciate if anyone can enlighten me on this Many Thanks Re: Rear Setback for small lot - Brisbane city council 2Feb 06, 2020 9:09 am Hi Romy, Below is an extract from the Brisbane City Plan Development code for Small Lots (providing your lot is classed as such). AO7 Development results in a minimum rear boundary setback that is: (a) 6m, where on a lot with an average depth of more than 25m; or (b) on a lot with an average depth of 25m or less: (i) 3m, for a part of a building or structure up to 4.5m high; (ii) 4.5m, for a part of a building or structure over 4.5m high. (c) located within an approved building envelope for the site to the extent of any inconsistency with (a) or (b). Editor's note—in interpreting AO7 refer to the deemed compliance with site cover and setback assessment criteria in section 1.7.6. Is the average depth of your block equal to or less than 25m? If so, you can adopt a rear setback of 3m to the outermost projection (being the eaves). Otherwise the rear setback it will need to be 6.0m to eaves, and you may need to lose the eaves. My understanding is that you exceed the development setback, however, only by reason of the outermost projection which is an eave, therefore the development is deemed to comply. Check this over with your Building Designer or Draftsperson.
