Hoping for some advice please...
We have a dispute with our builder re defective paintwork and withheld a small sum (approx 1% total contract value) from 2nd last progress payment. Have since paid final progress payment in the hope they would rectify other defects but they didn't because we still withheld small amount.
Have had inspection done by paint company sales people who say it's acceptable even though we see multiple areas of thin coverage and other defects. We engaged a coatings specialist who did microscopy tests and visuals and they believe entire exterior needs to be recoated plus defects rectified. Builder won't accept his report. Builder won't hand over final certificates until we pay up.
Our contract is now legally terminated but he still won't give certs. We feel if we pay for Builders incomplete defective work and also have to pay others twice the amount to rectify it all is just wrong...
Building is in Central Coast, NSW.
Any suggestions welcome...
