I have the following corner block in a little court in Melbourne that I'm trying fit a double storey house on (Vantage 48 by Metricon), however I can't figure out the setback requirements for it. Metricon doesn't seem to have a clear answer yet. I inspected similar lots and some of them have their garage setback aligned with next door neighbour while others don't follow this. I thought I'll post about this here in case someone have dealt with similar situation in the past. You advice is much appreciated. I'll share my findings once I hear back from Metricon. They seem to take long time to assess this though. Council told me that I have file dispensation plan and the council will study it and get back to me. Waiting for Metricon site surveying and soil test result to come out. Once we have it, then Metricon will engage their surveyor to make a decision. If the outcome is not what we're hoping for, then Metricon can file a dispensation plan to take it further with the city council. I was told that ideally the land developer should have set a building envelope for such land, that way there's no confusion as to where we can place the site. Like ⋅ Add a comment ⋅ Pin to Ideaboard ⋅ Based on this rule, my setback can't be more than 1/3 of lot depth (depth is 43.3m on east side and 41 on west side). So if I were to take 1/3 of 43.3 then my setback can't be more than 14.4 which will encroach on my neighbour by at least 2m. If I were to abide by neighbour's setback, my setback from the front of the lot will be almost 17 meters. Fwiw, I spoke to the city council again and they said they don't have an answer for me. They told me the only way to get a definitive answer is to apply for site dispensation, at that point they will study the sitting plan and make a decision. Re: Setback rules for this corner block 10Nov 22, 2019 11:13 pm I think part of the issue here is that you do not have a corner block, and trying to apply corner block rules here will get you nowhere. You have essentially what is known as a battle-axe lot. You are relying on the driveway past your two neighbouring houses to get to your house (that's the handle of the battle-axe). Some guidelines would say that you actually have 3 side boundaries and 1 rear boundary (which kinds sounds confusing in itself), but that basically means that you do not need to be level with the neighbour's house.
