Browse Forums Building A New House 1 Aug 18, 2019 2:23 pm Guys, want to get some opinions about custom design. For those who do custom design how do you deal with the following situation: Nowadays builders usually start with designing a floor plan. If you are happy with the floor plan and cost estimation, then move onto PPA. The question is, let's say you are not happy with the service, or cost, or over budget, or any other reason you wanted to move to another builder, how do you deal with the floor plans? The floor plan is designed based on your brief / simple sketch and you spend a lot of effort to amend and improve it with builder. I think the common way people do will give another builder same brief and the floor plan will be very similar or same. Appreciated anyone can share some experience. Thanks in advance. We didn’t end up using th plan, and now working direct with an architect. Smart move that’s what we should’ve done. We wasted a year and thousands only to walk away and then be told we can’t have the plans. I think had we pushed it we may have had a case to retain the plans, the draftsman just drew and fitted what we had drawn, probably what legally is deemed “intellectual property” was actually our intellectual property. Re: Custom design 4Aug 18, 2019 5:49 pm Yeah, this is our fourth build, so was aware of the pitfalls, started out from the beginning, ‘if i show you my concept, you acknowledge in writing that its my plan, my concept, and you have no rights to it’, they agreed. We also had in writing that we would be given the soil test and the contour survey in dwg format, prior to paying a deposit. So when we walked we took them too... Re: Custom design 5Aug 18, 2019 11:36 pm The builder has copyright of the plans unless agreed to it writing (as previously advised) would of been better going to a drafting company or an architect but hindsight is a wonderful thing.
