There are a number of protected trees on my site that I would like replaced and some kept. This will require me to put a request to council which I suspect will just get rejected. Therefore I'm considering compromising my design to accomodate the Trees and then go with CDC and get approval. My question is what happens if existing trees are then damaged in the future for some reason beyond my control. I.e. the roots are damaged by the builder.... I am liable to be sued...? Advice I am being told is that as long as you are not within 3m of the tree then you can build. If something happens then I am not liable. Thanks in advance. Part of a kdr da, we have a tree in the middle of the nature strip and we wanted to move our drive way to the opposite side it was on. They said we couldn’t remove the tree but we could spend a small fortune on ground radar to see if the drive way would impact the roots. We did this and they then replaced their council tree guy who’s attitude was “everything by the book to the full extent, no compromise” tree and drive way stayed put. I know right we would need to sell the house to cover the cost. The tree is completely lopsided because energy Aust cut the side out of it so it doesn’t touch the wires. That said I’m pretty sure our current drive way would also be too close to the roots based on their measurements. Re: Building near protected trees 9Apr 05, 2019 10:05 pm Any idea what is the procedure if you have a tree within your own property boundary and the driveway is being lifted by the tree. If I repair the driveway I will damage the tree roots and therefore the tree dies. Is one then able to plant new trees and have the troublesome tree removed.? Also if you go CDC how do you justify trees to be removed with council..? Lastly if I do go CDC is there a need to identify a Tree protection zone..?
