Browse Forums Building A New House 1 Mar 11, 2019 7:48 am Hi there, I have signed and HIA contract with my builder in Melbourne and paid 20k deposit. Now, I want to get iut of it.My contract states if I pull out I need to pay 30% of the cost of the work. What are my chances of getting out without major financial loss? Anyone with prior experience, please advise Thanks heaps Bibs Re: Getting out of HIA contract 3Mar 11, 2019 11:01 am It can depend on what stage you are at? Generally (most decent companies) will only charge you for what work they have already completed. If you haven't went to site yet, then it could possibly only be a few drafting costs and legal costs plus site works as in soil tests and the like. If you've been past colour selection then maybe a bit more if they have already ordered bricks etc Re: Getting out of HIA contract 4Mar 11, 2019 11:53 am Mike8136 Are you still within the cooling off period? Unlikely you’ll have to pay 30% of the contract price but they will most definitely hit you for all costs to date, including admin costs etc Speak to a lawyer...
