Hi,
I have applied to council to have required setback for our proposed build modified to 5.5m from the boundary.We are planning to subdivide and want to maximise the ability to build on subdivision. Our block runs between 2 streets. All other blocks have been subdivided already, with ours being the last. The council denied my request (R&C) saying it did not comply and needs to be average between my neighbors 6.67 and design needs to fit in with surroundings. .
The property one house away is having a Porter Davis of similar design to ours and has had council approval for a setback of 5.0m (Through planning). It should have a setback of 6.67m as well.
One of my neighbors applied a few years ago for R&C of 5.5M and got 6.0m.
None of our neighbours have any objections to our 5.5m setback.
I called the council and they said - the "decision has been made" and I have to go through vcat for review.
I have applied for VCAT review and have a hearing at end of March.
Can I please get some feedback for arguments for my case to present to VCAT.
So far I have:
House one door down has been granted a 5.0m setback and design.
Our design is in line with surrounding houses (with examples).
Our neighbors have no objections.
Any other arguments I could present would be appreciated.
