The terms and conditions state that - “Any factors causing delays to the nominated site start date that are outside of the builders control, may result in the voiding of this offer.” The fact that this offer is applied as a seperate Post-Contract variation means Porter Davis is able to void this offer whilst keeping the full contract in force, even if you are not responsible for any delays. Porter Davis have also informed me that the Post-Contract variation discount is applied to the final stage (10%) rather then distributed across all stages. e.g if you are building an Advantage double, with a contract price of $350k. The payment for the final stage is $35k (10%). With the discount/offer being $40k, Porter Davis will actually owe you $5k. Is there any guarantee Porter Davis will return to finish the home? Very risky.
