I recently purchased an off the plan home back in February. Contract of Sale signed. Its from a sole vendor who is building 3 townhouses and subdivided a block with his own builder commencing the build works Settlement was supposed to be back in February but due to covid it has majorly delayed the finish of the build. SO a couple of weeks ago we were allowed our final inspection. I hired Darbecca to perform the inspection. Darbecca produced a very extensive report and I am truly thankful for their thoroughness. (Highly recommended). The report has produced over 50 defects, alot related to waterproofing and the slab. They actually carved a trench through the slab in the garage because of a possible mistake with eh stormwater drainage. I have passed on the report to my conveyancer to communicate to the vendor. The certificate of occupancy was provided before the inspection. What are my options here? Am I able to rescind the contract? Will the builder be required to rectify all the defects before settlement? Am I allowed to delay the settlement to make sure these defects are rectified? I am extremely concerned now that I am going to have to settle this property and try to fight with the vendor and builder to try and get these issues resolved. What are my rights as a buyer?
