Browse Forums Building A New House 1 Dec 28, 2018 8:41 pm Hi There, My wife and I purchased a house and land package back in November 2016 through Simonds in heritage views, Greenvale. After a lengthy stint, our land finally titled in October 2018 so we were lucky enough to miss the sunset clause. Before Simonds started building, we were informed that there was going to be a fee of nearly $4000 because we didn’t start building in June 2017. Now this was news to us. In the contract where we signed, the dates of titling where put in at a later date by the Simonds salesperson (which you can clearly the see the different colour pens and handwriting). My question is, when buying a house and land through Simonds, are they legally allowed to charge fees for delay in building when all of this was out of our control? If we purchased the land then the house I understand that they charge fees but this was a package together? We really don’t know what to do but obviously we will pay it if we don’t have a key to stand on. Just feeling ripped off because they have also charged us another $1000 to re-engineer the house because on the preliminary plans the driveway was on the opposite side to where the developer placed it. The developer is saying that it’s simonds fault because they didn’t clarify that the plans were preliminary and didn’t conduct the appropriate site and soil test etc before hand. Re: House and land package- Fees associated with delay in la 2Dec 28, 2018 9:21 pm You need a home inspector who does pre contract inspections, has you will be pushed around easily with no chance against a builder who like many will not up hold your rights, look at this forums building expert website, if it was me and he was available, I would have him on board, it would make a unbelievably big difference to have such knowledge of your build and rights onside, good luck. Re: House and land package- Fees associated with delay in la 3Dec 29, 2018 4:48 am We went through a tender process with rawson kdr not home and land but they have a similar thing in there contract. The tender is valid for a period and if you don’t start building by then end of that time you get hit with $1200 a month until you start building. Unfortunately a lot of the delays were on their side and out of our control. They can of course wave the fee but they wouldn’t in our case. Most builders appear to have a similar thing because over time prices do increase. Read your contract see if it has any details about this and see what else you might be up for. You don’t want to pay it and then find that because the build is still delayed they hit you again. However if it goes for 12 months over the developer's allowed timing, then costs do go up and rightly or wrongly; these costs have to be passed on. Afterall this is not the builder's block. But developers are clever with their contracts so you can't really go back to them either. So the only person to hold accountable is the builder which is not fair. However if the builder knowingly provided you a tender with like 6 months and knew they should be 12 months because that's when the land is registering, then they should definitely be held accountable for it. For charging the extra 1000 for the re reengineering of your designs, that doesn't sound right. I would check with them and find out how this is your fault and then make a decision. You really need to be clear that your tender is fixed and do not take the consultant's or anyone's word that it's fixed. If it's not writing, then it never happened. There are certain steps that need to happen to have your price fixed upfront and then have them have it writing that is the final price you pay. A common mistake I find is a inexperienced home owners first homework of substance they do is when in trouble ,you find many on this forum with their first blog with a substantial problem, often no inspector and nearly always no idea if builder operates this way as normal.
