If the commencement of the building works cannot be achieved within 18 months of the initial deposit due to land title delays, the client not being the registered owner of the land or delays beyond the builder’s control, agreed damages of $250 per week will be charged to the client from the first day of the 19th month from the initial deposit date until Site Start. The client acknowledges that any agreed damages will be added to the Base Stage claim. My contract was signed last year August. They had the same promotion running at that time but unfortunately not mentioned in my contract. And they are not willing to put my case in that promotion. Haven't checked for the new price. The price was fixed as it was in their easyliving scheme and they don't list the base price separately. I would have thought they'd give the option of staying with what you have, or going to their new price, but builders being builders I can see them choosing the best option for themselve. I am in the timeline.. the point is.. they are not willing to include me in the promotion as it was not mentioned in the contract (but stated on their advertisement material).
