Our builder communicated only below: - Pegging finished Nov 2 2018 - Variation allocated construction start Nov 15 2018 Our builder did not give us any information except from above. Last december 1 2018, there's already slab out from nowhere when we visit the site. Our site supervisor did not even contacted us before start of the actual build. My question, can I claim that our actual start is the variation allocated Nov 15 2018 because that is the last information from builder? For example, the standard HIA contract in QLD says that within 10 business days of commencement the builder must give the owner a signed notice confirming the date of commencement and date for practical completion i.e. you shouldn't need to guess.
