Browse Forums Building A New House 1 Mar 28, 2018 11:55 pm Hi Guys, My building contract is a standard Master Builders Association of Victoria new home (H6) contract, it states the following under 17.5 owner to provide signed defects list to builder in certain circumstances - If at the final inspection of the works the owner claims any defects exist, or the works are in any way incomplete or not in accordance with the plans or specifications, the the owner must at that inspection give to the Builder a written list specifying such items and both the builder and the owner will sign this list and each will retain a copy. Notwithstanding the fact that the builder signs the list provided by the owner, the builder's signature is not an admission that the alleged defects or incomplete items exist in the works. 17.6 Builder will complete the works within 21 days of receipt of a signed defects list I am going to use a Building quality consultant to do this final inspection along with however he will provide me with a detailed report the next day as the number of items he needs to go through. I've asked around a few building quality consultants and they all told me that the report will be available to me in 24 hours. There is no one who is going to generate the defect list report on the spot My question is that as per the clause 17.5, I need to provide a signed defect list at the time of inspection however I wont have the defects list report from my building quality consultant until the next day. Does it mean that the builder can say that as I did not provide them with a signed defects list at the time of inspection they will not entertain any defect list that I provide them the next day?
