Champion homes cleverly sign us the build contract and there is written the 5% amount is non-refundable. I was unaware that it was a final contract, i didn't know the process. As I am in cool-off period. Is there any chance to break it and get my deposit? I regret I act so naively and trust the agent blindly.
Can someone give me genuine idea? what should i do? In tender they cleverly put sentence saying its non-refundable and goes to tenure fee (at last page) but while he mention us i deposit its your 5% deposit.So, I agree to pay now I regret how stupid I was to trust that agent blindly. Even while signing he's saying its tender sign but never told us that its final contract. Even he didn't send that document to my solicitor and broker. He call us to discuss as structure thing but cunningly he signed us the contract. Scam is such a harsh word, I would prefer to say "expertly extracted a non-refundable deposit for the preparation of Plans and Documentations." The process is as follows 1.The Salesman/Designer presents a Fake Coloured 3D Bim rendered Images along with an estimate. ( here is where the free service ends) 2. Then you pay a 5-7 % deposit for the preparation of all documentation 3. Then comes the time delays, variations, engineering and price increases, while you are none the wiser 4. The claim is 3 above is beyond the Builders control, and you will need to pay up. 5. On site it's referred to as having your pants pulled down (Humour) 6. The irony is it wasn't that long ago, trades weren't paid extras for variations while the builders creamed it Now that trades are in demand and in short supply they are telling builders to pay up or they'll PO from site. Thus after that we start to read the contract(already late for us) and found lots of things are with company favour eg non-refundable as tender fee but he told us its your deposit. what you mean by coloured 3D Bim?? Sorry I am new to this construction world . He only shows us floor plan with added some changes that we asked for and make tender and contract documentation. So we are up to that process..And now we are in cool-off period.... I am not sure whether to go with them or withdraw... The question now is "where are you within the Preparation of Plans and Final contract documents and pricing" If you are at the beginning of the process, then the builder may turn out to worse than the salesman for the following stages. Don't hand over anymore money and look out for the signs where they start delaying, gouging on variations changes, blaming others, Site work PS increases, over engineering costs, etc .I realise loosing the 5% deposit will hurt, at the first sign they're pulling your pants down WALK OUT...... Tens of thousands are just doing that I kid your not If your suspicions prove incorrect then fine stick it out. any contract, drawings and price increases always favours the builder. OT, Engineering Bim Data provides you with the means of checking, variations, estimates, pricing and IMO a must have before you lock in with any one builder. History Engineering Bim is a spin off from from Architectural Bim which has been devalued by Fake Marketing 3D house Renderings these are successfully used as a sales hook to suck Battlers and Punters in....imo an ugly turn in the technology.
