Currently, myself and my wife both have joint ownership of the property. After building we are planning to subdivide each duplex as Torrens title duplex. As part of subdivision, can we both own 1 duplex each without paying stamp duty. So, that I own 1 duplex and my wife owns 1. In this case, do we need to pay stamp duty? After the property is subdivided into two torrens title lots, you will have two properties with both names on each. At this point you need to execute a Deed of Partition which will effectively allow you to transfer interest in the properties to each other. This way you end up with two properties with one name on each title. You will need a valuation done for each property and if they are equal then its about $100 to pay to Office of State Revenue.
