Browse Forums Building A New House 1 Oct 20, 2006 10:46 am Well the builder has basically refused to do anything for us so now we are seeing a solictor on Monday to try to get some advice. When we signed off on the final plans for them, the salesperson has apparently never given the office the copy of the site plan. That's their story anyway. So if they say they never saw it does that mean they can put the slab wherever they want? It's not our fault they lost it somewhere!
This is so frustrating because who knows how long this legal stuff will take... evil evil builder doesn't want to take responsibility. So no one freaks out it is a local builder from north side of brisbane, so it's unlikely any of you will be building with the same guys, but if you are worried let me know & I will PM you the builder's name. I don't want to post it on here in case they find out and use it against me in court somehow... thanks again for your support, if anyone has any ideas/thoughts, please let me know. That's their story anyway. . And that is your problem because (insert pathetic stupid answers from the builders here.) The sales person is employed either by or on behalf of the builder? Goofd luck with the lawyers. Adrian B Re: Slab in wrong spot Pt 2! 3Oct 23, 2006 8:37 pm WELL, NOW I’VE HEARD IT ALL!!! This is a first for me….I can’t write what I’m thinking!! It will be taken off the forum!
I would not pay a cent to the building company; this in my eyes is their stuff up. Good luck with your solicitor! I hope you get the resolve you are looking for! I am constantly surprised at what goes on. This is a lesson….. And no offence to you! to people who need to stay 2 steps ahead of their building project and their builders. There is a lot involved with building a home or commercial site, if you do not do the ground work before hand you can expect some really shotty work. Be onsite every day! Make sure you know what is to happen next and how you won’t it to look. DO NOT expect anything less! If the builder thinks you are on the ball you are less likely to be given second rate work. No offence to the builders on this forum!!!! NOT all are the same. I have seen some disgusting trade work in the past and not all by builders and as you can tell this subject is a bee in bonnet! Good Luck!!! (Not sure what going on with the stars thing!! It should read “wont it to look!” ) Internal and External Building and Colour Consultant Online - Worldwide http://www.denovoconcepts.com Re: Slab in wrong spot Pt 2! 4Dec 06, 2006 3:53 pm Wouldn't the position or location of the slab be controlled by the local council? They have to aprove that it complies with the local restrictions etc I think. I'd like to know how it all went with your situation. I have heard of slabs being pulled up as they weren't built to plan. If the builder truely has lost it then unless you have a copy They'd have to take on the cost of all redrawings. Re: Slab in wrong spot Pt 2! 5Dec 06, 2006 10:06 pm Hi guys, thought i'd give you an update. We had to get a solicitor because the builder kept insisting it was not their fault. They screwed the solictor around (putting him on hold and never coming back, etc) but eventually they contacted us directly. They offered us cash to leave the slab where it was, we told them where to go. So they said they will move it. SAID being the word because as yet it is still where they put it. It is going back through council (at a cost to US!) and then apparently they will start again. But it has put us months behind which is so disappointing. I would never recommend them to anyone no matter how great a house they end up building us. They're just not worth the trouble.
Thanks to everyone for your support and as soon as they actually DO something i'll let you know! Re: Slab in wrong spot Pt 2! 6Mar 16, 2007 7:52 pm That's awful! How can that be at your cost to put it through council again?!? Have you spoken to your solicitor about the idea of going to the local paper? Do you have to build with them? Re: Slab in wrong spot Pt 2! 7Mar 17, 2007 8:07 am Time for another update! Well it took them FOUR months (instead of the 2 weeks we were promised) but we finally have a new slab in the right spot. It was laid last week. Last week i got a letter from the builder asking for an extension of time. I told them where to go! Otherwise there will be no motivation for them to hurry up and finish the damn house!
From Jen H: That's awful! How can that be at your cost to put it through council again?!? Have you spoken to your solicitor about the idea of going to the local paper? Do you have to build with them? Going back through council cost about $600 i think which isn't that much but it wasn't our problem to be paying for. We couldn't really change builders because we had signed the contract and to go to another builder we would have had to pay to get the slab ripped up ourselves so it just wasn't worth it financially. I was considering getting the media involved but i think that will make the relationship with the builder even more tense. We will see how the finished product ends up! I'll keep you posted. name the builder 10Mar 23, 2007 6:08 pm Please name the builder as they seemed to build every where.
Next door to my house ******* builder registered in Robina (just 2 years on the market) positioned his GREEN house accross the land with the corner on my boundary. This block of land is 600m2 and they turn it around to not to cut the DEAD tree.... There are certain things that builder should not do... so if they will have less business this will be the best punishment. thanks kate Re: Slab in wrong spot Pt 2! 11Mar 23, 2007 6:38 pm Just a quick note to add my 10cents worth ! Princess Sooty , great that you keep coming back and updating. So many people have seemed to start a thread then not bother finishing it ? Its like reading a book and finding the last 2 pages have been ripped out ! Hope things are going smoothly for you now ?? best wishes "MO" Its better to regret things you,ve done, than things you haven't. BUT Never regret growing old because some people never have the privilege. Re: Slab in wrong spot Pt 2! 12Jan 03, 2018 4:43 pm Hi, Looks like I'm in the same boat as you but I have Complying development stamped approved plans that the builder cant even say he never saw. My builder has made me pay 10K to encase a sewer line so that I can build my house over the sewer and not lose any backyard space (2 metres if I didn't opt for that). But whilst they encased the sewer, they also decided to use a draft version plan that was not to include the encasing which meant I lost backyard.... So somehow they used the wrong plans and not the approved signed and stamped ones. Not sure where I will end up with this. The builder is on holidays and nobody is answering my calls/texts and emails and I have to wait stressing for another week before they get back to work and advise me what they intend to do. Only option is to demolish the slab for me as well and build where they should have built as I have a pool going in. Cant believe the incompetence. A surveyor, site supervisor, concreter and certifier all missed that they built the slab in the wrong spot. I was the only one that noticed.
