Siteworks have commenced on my block and I received a variation 2 days after the the work which was listed on the variation had been completed. From what I can read in the HIA contract a variation should be provided and signed by both parties before the work is commenced. Interested if anyone has had a similar experience and what the outcome was. Cheers! We’ve had many post contract variations as well as building variations but usually it will be for something our Building Coordinator or Site Supervisor has chatted to us about first. Depending on what the works were, it may not have been feasible to request the variation first? Ie if it was identified during slab pie maybe? They rang me and first tried to give me the option of organising for it to be done myself or get them to do it. When I advised them that I'd already gone past the site and the work was done then it obviously became just a variation with no option. If they are not agreed upon don't pay them They needed to excavate along a retaining wall to put in some additional support, this work was already agreed upon in a variation and agreed to during the pre-start phase. Obviously with builders margins this wasn't cheap but we figured it would reduce the stress of trying to organize it ourselves.... This new variation is because there were some vines growing along the retaining wall which needed to be removed. This vegetation was noted in the survey which the building company did and was clearly visible for anyone coming on site to quote for the excavation. I'm not sure how an excavator/digger would have any issues removing the vegetation when it had to dig 2m deep along a 30m retaining wall but then again I'm not an expert on excavating. I guess my issue is getting the call and the subsequent variation after the work has been done without it being agreed to nor do I believe it warranted in the first place given the quote and variation for the work had already been agreed to. Assuming you've modelled the TB8, TB10, TB12, TB2 & J1 joists/LVLs there, it appears as per drawing to me.
