I recived 2 invoices in the last 2 days and both stages are not complete... very frustrated they had been good until now. Thanks. Yes I have. But I wasn’t too fussed. They would complete majority of the work before invoicing and the minor things would be complete the following week. The work is non-compliant or not specified as a variation in writing 3.The SS says "It will be fixed up later..." I rang them and said the work wasn't complete and they could reissue the invoice when it was. They agreed and sent me a new invoice a week later when things were done! I’m building with M and I received invoices either the day work finished (eg slab pour) or prematurely (eg frame stage complete but windows weren’t in). My policy was not to pay until the work was done AND my building inspector had inspected AND any reported issues are resolved in full. The only real leverage you have is payment. Do not pay unless you are happy. That means you must be able to support your non payment with an independent building report detailing structural defects which in turn means the required work to meet the trigger of a stage of work for progress payment has not been met. This is the quality assurance you are paying your builder for in their builders margin. This principle is guaranteed by Australian building and consumer law. Identify all defects and get your builder to fix then as they go. Certainly before you pay the next progress payment whilst you still have some leverage. Make sure you notify them in writing. Check if email is appropriate communication - it may not be! Make sure you understand it something is acceptable or not, don't just take the builders comments at face value. Don't be rushed or bluffed. Don't accept any excuses or promises to fix things later. Don't wait until practical completion and handover time as some defects may be covered over to surface later, and your timing and circumstances may force you to accept compromises in quality. You will then have to expend your own time and energy project managing the 'warranty' repairs later with the builders after sales 'customer service' . Phone calls, waiting, tradesman visits, mess, inconvenience, frustration etc... Check carefully, understand, expect and demand your builder gets it right the first time, before moving on to the next stage. A professional and conscientious builder will take pride in doing this. Shelves have not been fitted in Walk in Pantry and wardrobes. Architraves and Skirtings have been complete. Kitchen and Laundry Cabinets are fitted . The accounts guys have sent an email to construction manager asking to confirm if the works have been complete One thing I implemented with my site manager was a walk thru to inspect work at each progress payment stage. If they try to brush you off, you are entitled to per the contract and failure to give you access is a breach. This is your chance to then walk around and take pictures and point out defects that you might have detected on other visits. Following the meeting, I would always send an email to the SM and Cc the CM what was discussed and any key remedial works agreed. This method has been invaluable because i’ve had 3SMs and 2 CMs during my build and so they can’t claim I didn’t notify them of the issues and I can prove it via the emails. I am trying to chase the CM and SM to give me a feedback but they are not responding. I’ve had quite a bit of success with M’s Customer Care team new Melbourne. They do seem to listen and have been very helpful in getting a resolution for me. Make sure you follow the dispute procedure clause in your contract and relevant state legislation absolutely to the letter. Otherwise if you don't pay within 7 days you could be in breach of contract. Especially when the stage wasn't complete (in a very small way) however a heap of work had already progressed into the next stage, the building inspector advised to pay the invoice as long as the work was satisfactory. Re: Metricon Premature Invoicing 16Dec 08, 2017 2:10 pm You are not in breach of contract for failing to pay a progress payment, if you are asserting that the work required to achieve that progress payment has not been performed. All you’re saying really is you’re happy to pay once the work has been done. And if you have an independent building inspectors report to support your claim, then the burden of proof is on M to refute the report and prove the work has been done and is of reasonable quality. If they kick up a fuss about it, you could pay say 75% or the invoice.
