We accepted a tender from a one of those top builder but going through all the processes now and looking around for some options, the build of the house will be something we might regret for a long time. Right from the the side of the garage in the land to setback, they kind of pushed us into things that probably made their cost lower than our preference. Is there something that I should be aware about changing a builder? Is there any contractual obligation for loss on their end or something? I don't think I will get tender deposit back which we think is ok, we just want to walk away from our previous builder. Anyone faced similar issue before and how did you deal with the situation? You need to accept that you may not get the tender deposit back but you can talk to the builder and see if they can return any part of the deposit as goodwill after deducting their costs so far. Thanks Gregorian, We have accepted and signed the tender. We have also made the tender acceptance deposit. We did go through the contract and didn’t find much about the implication of not continuing with the builder. I don’t think we will get the tender request and tender acceptance deposits back which we are ok with. We’re wondering if there is some other aspect or some other charges that we may be accountable for. Go through your tender terms and conditions carefully but highly unlikely the builder can charge you anything more. Does not work that way, in one case the builder then sued the client for all the work done between quote and cancellation. Builders work on the basis of "low ingoing" or "bait and switch" and give you a single-page specification and quote, which has, e.g., wall painting missing or a proper garage light missing or lousy door handles, etc. In fact, in my case a builder offered $10,000 less once told they may not be in the race.
