Browse Forums Building A New House 1 Sep 06, 2017 2:48 pm hi, can anyone offer some advice please? Currently building our first home. After struggling to come in on budget on some fittings, I pulled out the original quote and spec to compare it to the one we're working off. This showed that the original spec stated "x amount allowance supplied by client" (for said fittings) while the spec we're working off shows a different amount at x. Essentially there's over $2000 difference. This led me to add up the totals as it appeared to be a simple error in information not being moved onto the new spec properly. I'm glad I checked the amounts as it appears there's more than $6000 "missing". I spoke to our builder regarding this and assured him I thought it was an innocent maths error. He denied the error and hasn't taken any action to remedy this stating that the contract is already signed. It's there in black and white between the original quote and spec to the current ones. There's over $6000 missing. Signed contract or not, surely this should be rectified? Thanks in advance Re: Discrepancy in specs $6000 "missing" 3Sep 06, 2017 4:20 pm Misstee hi, can anyone offer some advice please? Currently building our first home. At the end of the day, they have to explain to you what is the differences. By law, what has been signed, it become the latest changes and agreed by both parties. Therefore, if you didn't check it prior, then, it is actually your fault, but you are still allowed to ask the explanation. It is their job to explain it to you. My suggestion to you : - Revised your original and compare it the latest signed document item by item. - If the figures differ in council requirements, then you cant do anything other than asking for proof of invoice. But, if the figures differ in item selection then you can get it to your solicitor and/or ask them for explanation - Try to add up all the items and calculate the total, if its maths calculation error, show it to them and don't sign it till you double check it. Signed contract shows amount including the $6000. After the original quote and spec we made changes and so the updated spec shows the new amounts and a description like "changing roof tiles to colorbond saving of $3000" and "changing outside cladding to fibre cement $2000 extra". So the new spec that we've been working off clearly shows the changes and how much each change has cost or saved. Yet, the amounts don't add up. I did the maths by starting with the original quote price and added and subtracted all the amounts shown in the updated spec. My concern is that the builder has dismissed it when I showed him it in black and white. I really don't want to have to seek legal advice and have the whole thing blow up. I really just want it to be remedied amicably and honestly. I was hoping someone might have knowledge or experience of how these things are or should be handled. (Tips, use Excel) Hi, we didn't use a lawyer for the building contract, unfortunately. Builder came recommended from a family friend hence my naivety in not checking the numbers properly before signing. It is my understanding that a discrepancy like this is equal to non disclosure and null and voids the contract. However, I really don't want to go down that route. Thanks for responding Re: Discrepancy in specs $6000 6Sep 06, 2017 6:12 pm Misstee rayDC2R If your signed contract includes $6000 worth, then show the builder... Thank you for your response If the builder doesnt want to acknowledge it, then you have no choice to seek legal advise. If you dont take legal advise, the builder will do whatever they want. Imagine, even with black and white, they ignore you. What happen when the building goes south, what are you gonna do? Do you think they will care? Without legal advise, they will play with you. No one should be affraid if they do things right. My advise, talk to legal. I dont think that they will remedy this. PS. Dont be affraid that they will mock arpund with your building. If everything by legal, they wont do anything funny. To my understanding early saw cuts are to control shrinkage cracks, so doing them now would be pointless.
