Browse Forums Building A New House 1 Jun 17, 2017 3:54 pm Hi guys, We have been recently settled on a block of land in Bayswater, Western Australia and are ready to build our first home. We have selected a builder and have already signed out building contract. Unfortunately we have run into trouble already. The verge is not separated from our property by the footpath but instead we have the footpath, verge, and then the property without any division between our property and the verge. The issue we are currently having is that the mains water pipe for the street runs through the verge and is ever so slightly higher than the footpath and street level. The pipe is located approximately 2 meters back from the footpath. This means we will be unable to build the crossover in the current state and do not have enough room to build up the land over the pipe as it will become too steep. We contacted the Water Corporation and they have identified the only solution being to lower the water mains which is a significant expense. We’ve been told it’s in the thousands but are yet to receive a firm quote. Is there any organization or group we can get in contact with in order to get some advice on how to deal with this situation? It seems to us that the block was sold to us in an un-buildable state, and we want to find out if there is a way we can avoid paying for lowering the water mains pipe. We believe that this issue should have been identified and resolved during the subdivision application to the WA Planning Commission. Thanks, Pete. And really sorry I have no idea how I would approach this, but seems like a solicitor is probably the way to go. (Hopefully you can find a good and helpful one!)
