They are now starting to build and are using what I had thought would be a rear boundary (the one most psrrallel to the street) as a side boundary so are building within 90cm of it. So my question is who decides what is the rear? There decision means we will get no afternoon sun in our backyard and they will be looking straight into our pool area. Thank you. You can start by approaching planning and building departments in your council to get some answers and guidance. I am familiar with the setback requirements in the legislation and I have contacted council (not very helpful) and the guy who approved the complying development. All refuse to show any plans.
