I'm pretty much going to use our contract and see where that gets us - no mention in the contract that the gate post would have to be removed, just the paling boundary fence. We've just returned from looking at a Metricon KDR around the corner from us - they're not even building on a zero lot boundary (about 150mm setback), and their garage guttering is the same as yours. I think their building surveyor has stuffed this one up; as it should have been picked up at plans stage.
