Browse Forums Building A New House 1 Jun 06, 2017 1:21 pm Most my friends whom have built with volume builders always say, they have been told their not allowed on site as is in their contract they believe, but in Victoria your right to reasonable entry overrides contract entry, if you work monday_friday, say 8_5,and your slab is to be poured Monday 8am,its your right to get on site before the pour, even on weekends, they must comply, don't be fooled. However, the operative words are "reasonable time". What is reasonable is always a question of fact. Consider now that owner grants builder exclusive licence of possession during the build. Builder has the obligation of site security and safety as well as OH&S, therefore must control who comes and when to avoid site injury of persons uninvited and unexpected. The site also must be safe for visitors and the builder has to have advance warning ( What if husband and wife drop in with kids whilst cranes are unloading materials on site?can you see my point) On commercial building sites there are agreed times for regular site meetings when owners can view works and discuss progress, variations etc. On domestic sites, it is less formal but what is reasonable must prevail and nothing beats talking to the ss and nutting it out. As a builder I would not want owner around every day but twice a week no problem, I have heard of owners hanging in there every day and for that I would end the contract. So the bottom line is yes it is your land but you have given licence to occupy to someone else and you cannot have it both ways.
