Throughout the whole process we chased and chased the stage certificates (slab, frame, engineering, etc), only to be brushed off by the builders multiple times and told we would "get these at the end". Impossible now as they no longer exist. Is there ANY WAY to collect these retrospectively? We have already contacted the original appointed certifier, who claims the certificates are with the builder. They have no copies of them. We are also contacting council to see if the certifier had lodged them at each stage (unlikely, but it's worth a shot). QBCC does not give advice on this - it's a minefield and they don't want to get involved. It just feels like no one wants to take responsibility for these. We took a million photos of everything throughout the entire build. Is it possible to present these as evidence to a certifier to get the required certifications? Any assistance, advice, or where we could start, is greatly appreciated. We are in the QBCC qhws process now but have to try to get all aspect certificates together as none of our stages have been certified as builder has he was not provided any form 15s,12s or 43s. The Builder is holding onto all of them and refusing to provide them. The Businesses, Engineers, Frame company, Surveyors site setout all refusing to supply us copies because they were engaged with the Builder and not us. No protections it seems for the consumer here. Generally you have the right for getting all signed forms for the work completed and paid for by you, specially form 12 as it’s hard to obtain when work is completed (for example concrete is poured for slab and walls are lined) Re: Builder in liquidation - collecting stage certificates? 5Nov 19, 2024 6:15 am QBCC will do nothing to assist as they claim it is contractual and they can't assist. They tell you to get a lawyer. The same thing has happened to me. I have now found out that the builder has not paid the suppliers so they are holding the certificates until he has paid them. I don't have one single certificate yet. The contract is terminated and not even at enclosed stage. Stuck in QBCC waiting for HWI claim to be processed. It's been over 8 weeks now.
