The building contract states that the builder is not required to obtain any certificate of occupancy or final inspection certificate relating to the building works. However, attached to the contract is an authorisation letter for the builder to submit the following on the purchasers behalf (i) Development Application, Construction certificate Application, Occupation Certificate Application and any other Applications required by the Principal Certifying Authoity. Who is normally responsible to apply for the Occupational Certificate / Final Certificate? Is this the same thing? Should I be worried about this if the builder does not intend to apply for this? Further, your contract details the deliverables and payment schedule. In most instances the builder is contracted to complete the building and hand over a house ready for occupation. The annexures are tools to allow the builder to act on your behalf when dealing with council. If you are in doubt, you can contact your local council officers Monday to Friday typically after 1pm.
