We are doing a KDR too in the eastern suburbs and this thread has been so handy! Still living in the house we will be knocking down. Our plans are at council now - fingers crossed all will be ok given we had the same issues at council you are having now Bri1234 with the setback.We ended up choosing another house plan. What was the set back of the original house/garage? But I'd speak to a town planner that have dealt with Greater Dandenong for some verbal advice. Even call up the council planning department. They will give you some general advice. So we had an appointment with someone from drafting for this week but he ended up off sick on the day and then apparently for the rest of the week was supposed to be in head office. So we now have an appt for next week. Hey whats another week other than more money. Yes I'm feeling bitter at the moment. One thing I did do was go and chat with our neighbour on the other corner. Their shortest setback is 6.5m so seems unfair for the council to insist that ours be 7.5m. Anyway, hopefully we'll know more when we eventually have this meeting. Shame that they couldn't provide an alternative draftee instead of rescheduling. Is there anyone at town planning with the council that you can met with to discuss why you have to have a 7.5m setback. Or even check out the other corner homes in the area to see what they are besides the one across from you? I really hope that the draftee can weave some magic for you. Good Luck. Then we’ll decide what we need to do like talking to the council town planning etc. kind of hoping drafting will have a great idea but not holding my breath. It wasn't any help. He referred us back to the building department. Our main query that no one seems to be able to answer is will they budge on the 7.5m setback or is it firm no negotiating? From what we are getting it sounds like we have to try and rejig our plans to come closer to 7.5m and just reapply and see what they say. It all just seems like such a waste of time especially when they are telling us that they are swamped with applications. What is Simonds doing about all this? Sick draughtsman, no clear direction. I'd be asking for a return of my deposit and seeing a lawyer for damages/ expenses incurred! The sales agent shouldn't have sold you on that design in the first place! It was always going to be too big (there is quite a fair bit of dispensation difference). The draughtsman should have picked it up and flagged it when they drew up your contract. These was exactly what happened with us BUT we hadn't knocked our house down. We made clear that seeing as we had to look at another design, all builders were back in contention. I spoke with the Council Town Planning Dept (no help) and also a private Town Planning Organisation. They were helpful with advice but not in being able to help us. They pretty much said that councils could be very stringent with their regs but it's also up to the discretion of the person assessing the application at the time. We might be able to get some dispensation but most likely they'll stick with the 7.5m in line with the house to our left. Because we are on a corner it makes it harder. Thanks Lenz88, We went in to this as rookies and are really learning and regretting now. We loved our salesperson but looking back now she should not have sold us on that plan the way it was. I'm sorry to hear that you're having so much trouble. I have hated every minute of this experience. It's been constant fighting and negotiating and chasing people up the whole way. Our admin phase was just over 12mths!! That was with a straight forward house with no structural changes. Council took 3mths to approve our application. Re: KDR - SE Melb - Simonds Flinders 120Oct 07, 2017 1:58 pm It's been a few weeks and a few things have happened so I thought I'd give a quick update and fingers crossed I don't jinx things, lol So as part of our build we needed dispensation from our council for our setback. We asked for 5.83m, they wanted 7.5m. They rejected our plans. A time was made to sit down with the drafting manager and our CRC to see what changes we could make. This took a few weeks because he was unwell and then working in the head office. We finally got our appointment and went in feeling pretty down about how on earth we were going to reduce our build by 1.67m and still be happy. We couldn't see how it could be done. As it turned out the DM had had a good look into it all. He's spoken with the council (who were no help to them either) and he'd gone over all the regulations. He had a plan. In the end we managed to move the whole house back slightly, about 100mm, on the block but still not have it on the easement. We also lost 480mm out of our garage which wasn't too bad. We had increased it originally for storage space. So we lost some of the storage space we wanted but everything else about the house is as we wanted it. Including our facade, Yay. Between these changes and whatever way around he found in the reg's, we got an email a few days later to say the building surveyor had approved our plans, no need to go back to council. Woohoo! So right now we are waiting for the final building plans to be drawn up and we're still waiting for final site costs. But hopefully we're not far off going to site. Fingers crossed. We were lucky in that our old house was so small (86 square metres) compared to the new house, they were able to take enough readings around the old backyard house before… 8 37085 The biggest challenge will be if you take out a loan and then run out of money - you'll have an incomplete security and lenders do not like this so you can get stuck.… 2 19068 Hi, I am looking into doing a KDR in Melbourne and am contemplating using Kialla Homes.
