Browse Forums Building A New House 1 Nov 19, 2022 9:14 am We’re a couple of weeks away from handover and our neighbour on one side is reluctant to put a fence in until their handover which is at least a couple of months away. We initially reached out to them in Sept and they’ve only just got in contact. Our issue is we have a dog and that side of our house has large windows so will have absolutely no privacy. They have access to do site levelling at the back of their house so that isn’t the issue. We’ve found out neighbour owns a fencing company so wants to do it himself (totally get) but isn’t able to do this until his handover because he lives on the other side of the state. Is there anything we can do if he tries to force a delay? We know we can issue a fencing notice (which we really don’t want to do) and give them 30 days to reply but if they do reply and say they don’t agree, looks like we’re at stalemate and we effectively can’t move in. Grateful for any advice/ ideas. I am in a similar situation Just wondering what happened with your issue This is my story I am almost done with my construction and keys will be in my hand in a few weeks. And I plan to rent out my property.. I initially contacted my neighbours by getting the information from the local council. Initially wanted them to contribute 50% as they should fairly do.. My Nextdoor is an empty land ..and the owner wants me to wait without doing a fence until they finishing building their house. They say their garage will be built to the boundary according to their plans.. They plan to start in about 3 months and if build goes for 6 months that means I am to stay without a fence on one side almost 10 to 11 months. Right now I am happy to 100% for the fence.I cannot rent out a property without a fence according my my real estate agents. Can I build the fence without their consent. ?
