What is the process for preparing land for subdivision in regards to sewer approvals, land titles, council? What I have so far is: 1. Council must approve Development Application for estate subdivision 2. Developer prepares land for subdivision including installing all services 3. Relevant water authority must certify the sewer arrangement 4. Title registration 5. We can start applying to council and then once approval gained, start construction. I can't find out what Land Titles will require for registration of the titles. Is my understanding correct? (I have a feeling there are a lot of gaps) After 4 years - we're in! long time reader, first time poster. I will speak from a (vic) surveyors prospective, which may not include all steps, or cover the same steps required in NSW. we, lodge planning permit to subdivide with council we, lodge application for certification of plan of subdivision with council council refers plan to relevant authorities authorities inform council of their conditions council makes decision and if ok, gives permit to subdivide (with all conditions) and may at this stage 'certify' the plan. This means/helps little to you at this stage. Then we all await the construction to finish, and if all the conditions imposed by Council and Authorities are met (as per permit) the Council issues a 'Statement of Compliance' which is aguably the most important document and a good day for you the purchaser. So in a way Council act for you, and don't allow the Titles to be issued until all the works are done, sewer, water, roads etc. I know its frustrating to wait, but you'd be far more peeved if you had your paper Title and the developer was off site when things went pear shaped with sewer bubbling into your 'under construction' house. With these documents, together with fees and the required survey documentation, the whole lot can be submitted to Titles Office (Land Registry in Vic). Registration of the plan and issuing of Titles should follow within 2 weeks subject to documents meeting the requirements of Titles Office. I know that the water authority is definitely doing the certification now - so good to know they'll need to go back to council before land titles. Welcome to the rollercoaster of building! Mind you it doesn't help when council springs a new set of standards on you at the last minute, after they have had the drawings for the driveway and services for 3 months .
And yes it takes forever, our subdivision was approved 12 months ago, we'll be lucky if we have the titles by January, and ours is only a 4 lot subdivision...I imagine it would take a lot longer for real subdivisions. Then the developer went through a re-structure internally - at this point, someone looked at the subdivision and realised it wasn't all that great. So they re-divided, had to lodge plans for the whole thing through Council for approval again. They started site works in November 07 and we were told it was 6 months until titles were registered (supposed to be May 08). The good thing is that we've managed to save an extra $100k over the 2 yrs we've been waiting - means we can do a lot of nicer things with the house we couldn't have afforded 2 yrs ago. Downside - we want to be in there now! I did have huge plans for my 30th in Jan 09 at the house - but we've got 1% hope of making that timeframe. After 4 years - we're in! I take it all the services have been built including roads? There is also contributions to be made (money) by the developer and Guarantees and if there are issues with the developer not meeting these the authoritys will not allow release of the title. Feb 2006 is a long time. Becarefull that the original develpment is as you first expected as a developer will some times go back and redsubdivide to cash in on a change in demand (for smaller blocks etc.) I would suggest the developer has had or is having problems them selves. Try talking to the engineering or planning dept in the water Co or Council to see what the hold up has been.
