Browse Forums Building A New House 1 Oct 10, 2016 11:29 pm Hi, Need some advice on a retaining wall. A builder is building a spec home next to our block of land that we will be starting to build on in the coming weeks. They commenced construction before any one else and have cut and filled there block about .5m. They have then installed a retaining wall about 200mm from the boundary around the whole property. The problem is we are also going to cut and fill .5m so on our shared boundary there is going to be another .5m of fill. As the builder has already constructed his retaining wall to .5m they are saying we have to build a secondary retaining wall on out side of the property. This does no make sense to me and I think since he has cut and I have filled a joint retaining wall would be better. We are on the Sunshine Coast QLD and if any one has any advice on what we could do would be great. This helps avoid disputes or legal civil action arising during or after the construction work. Further information in relation to building work disputes on or near property boundaries can be found at the Queensland Government website: www.qld.gov.au/law/housing-andneighbour ... dbuildings The sharing of costs for the construction or maintenance of a boundary retaining wall is a civil matter that must be negotiated between neighbours. Council does not provide advice on these matters or provide dispute resolution. The problem is that the builder has rushed in a built a retaining wall near the boundary that suits there cut but doesn't allow for the fill we will be doing. So they have payed when they where retaining their land. If you now need to add a new one due to your site works, it is solely your responsibility. Yes, a joint retaining wall would of been ideal but they would of had no idea what you where planning when they started designing months ago. Sorry to be bearer of bad news.
