Browse Forums Building A New House 1 Sep 07, 2016 1:19 pm I would just like to get an opinion as to what I should do with a few developments that have just came to light regarding my build. Sorry for starting a new thread, but I did so hoping it would be read by a wider audience rather than getting buried in my normal build thread. A bit of background – Deposit paid 26/4/16, Contract signed 7/7/16 and plans have been in at council since 19/8/16. There is an existing 2 bedroom house on the block in the process of being demolished and there is a sewerage easement running down the side of my block from front to back parallel to the fenceline approx. 1.5m from the fence. All the way along, the builder has been aware of the sewerage easement and the contract shows a plan layout with the new building in a similar location to the existing house relative to the sewerage easement. I have just been advised that the plans have been rejected by council due to being too close to the easement. The builder has advised that my option is to move my house a further 1m away from the easement and make the eaves on the garage 450mm instead of 600mm. I don’t want to do this as moving it away will reduce the size of my usable grassed area and create a larger unused area to the south of my house that will be in constant shadow and virtually useless, not to mention that having smaller eaves on one side of the house will make to look out of balance. After finding out about the rejection, a quick search (2min) on the council website clearly shows that there is a requirement to build at least 2m from any sewerage easement. It was in the council’s Complying Development brochure. If I could find this out so quickly, why didn’t the builder know this and notify me at any point? I understand the council set their rules and are unlikely to change them, but does anyone know if I will have any recourse back to the builder for proceeding this far without informing me. I would have thought that the builder or the builder’s certifier should have alerted me to this before it going to council. What do you recommend I do from here?
