I just put a 1k deposit on a lot off Dalmatia avenue.....I hope I don't get screwed over. Well.....thankfully my solicitor advised for me delay the exchange which the developer had agreed to (not respond actually). The contract did not include the deposit plan that will be submitted to council. Additionally, it did not include any indication of easements or slopes. As soon as that is ready, I will be considering placing 5% deposit down (27k). That's okay because I'm getting married in February and we aren't in a position to borrow 800k. This way it allows us time to get ready. I just hope the wait doesn't drive me insane. House & Land packages were designed to meet this. The dwelling size on our building contract is 145m2 which means that it doesn't comply with the current restriction. The houses originally designed by Metricon now do not comply with CDC regulations – the rules of the CDC are that they must comply with everything in the 88B Metricon said the developer did not notify them on this changes and the restriction is set by the developer not by council. They gave me two options : 1) build larger house, 2) Metricon re-lodge new DA to council The second option sounds more realistic but of course it'll takes longer process than CDC. We don't mind wait a bit longer. But what really make me really angry is our current tender will expired on 28/2/17, and Metricon said that any additional months required after that we have to pay $750 per month. This is so ridiculous! All this issues caused by the developer why are we the one who has to pay the cost ! I am now waiting for them to give me the cost of cancellation. Enough of these dramas. I've also checked with my solicitor and she said she never got informed on this changes. Can anyone please advise where we stand as a buyer under this circumstances ? are we gonna win if we fight against this? I saw the draft 88B and once the land was registered, my solicitor provided me with a new 88b. I'm pretty sure she did this search herself. Basically, the conditions were totally different, however they were not adverse to our plans. I think the only thing I was slightly annoyed at was the roof colour lol, lucky for us no one can see our roof from street level and we can use a different colour flashing because there is no mention of this. As for what you can do now, you have already settled, so nothing with the developer. Prior to settlement you could have made a claim under standard clause 6 & subclasses of the contract of sale of land. I note that the 88b allows you to gain permission from the developer to request a change however it does say that this would be at your expense. I'd try out it through DA again with the 88b in place. How much under the threshold are you? Could you add an interest grated pergola/alfresco to get you over the line? In my opinion though, your solicitor should have done the due diligence and looked at the 88b when you signed and ordered a copy of it when the land was registered. Metricon received no update from the developer in relation to this change. There has been no reason provided for this restriction being set on the blocks We are 14.31m2 under the threshold but metricon said if we want to proceed with building larger house its gotta be by at least 45.13m2- I am waiting them to clarify where they got this measurement from. Btw, my land hasn't been settled yet as we have only been informed by developer's solicitor that that it's been registered one week after yours is registered so the settlement date will be this Thursday the 8th. I have emailed my solicitor to check if we can make the claim you mentioned above. If we proceed with the DA our concern is we don;t know how long it's gonna take and it go beyond the contract expiry date (28/2/17) we have to pay additional cost $750.00 per month. Spoke to one builder yesterday who also built in that neighbourhood, he said if we lodge the DA to council again it'll take much longer as he's got several of his customers still waiiting for the DA to be approved after 9 months. Either way we are going to end up paying more. I am now waiting for Metricon to get back to me with the cost of cancellation and will decide from there. They designed a house which is not permitted in my block if land, so why do I pay for cancelation of a house which cannot be even built??? Even though this is a H&L package the land has to be purchased from existing land owner and Metricon will build the home. As owner of the land has delayed to prepare the land for a long time (1 year+), now Metricon wants to charge me additional 14,250$ for the delay (to build the house) which is because of land owners delay of delivering the land. I am feeling this is not RIGHT, as Metricon is the one sold as H&L package, and they should take accountability of the delay of land registration. Any of you received such email for additional charge? What happens if I buy land from the owner, and build the house with another builder? (May be not an option as I have paid nearly 15k deposit to Metricon, and they may not refund me that money!!) I am so frustrated, if I knew I would not have bought the H&L package from Metricon. I found the aforesaid builder to be very clever with their initial prices but because i had a colleague who was about to spend $500k without flooring for a 41 square home, i retreated and didnt accept their attractive pricing on Glendale 38 in my Edmondson Park block on Buchan avenue. The sad reality is i ended up paying $500k to Eden Brae Homes for a 43+ square property anyway and Metricon was offering at least $30k discount for similar sized property. Landcom delayed the handover of property by 3 months ... even though it was registered in Feb i could not settle until March as Liverpool council did not have the registration information available to them for one month ( ridiculous timeframes in the age of Information Technology where XML data can be sent across agencies such LPI, Landcom and Liverpool Council ... so much for their ePlanning website being another mediocre product). So EBH charged me $4k for 4 months delay and did not start construction until June and they deliberately wasted 2.5 months doing 2 weeks of work so that they can delay the handover until 2017. So i wasted $4k because of Landcom's delay and $3.6k for 1 month of Eden Brae's delay. At the end of the day they are all out there to exploit us because governments do not pass legislations to protect vulnerable consumers like us. Liverpool Council had a bit of a wait list for their DAs at the moment. To comply with this condition they would need to increase your home size. They gave two options as after council assessment. Submit Section 82A application or increase home size. I can see both these options would take more time. Did anyone had similar condition and proceeded with building? Yeah mine about 9 metres long and 8 wide with slope of 25% at one point but the end point of the outlet is past the side of garage and if he concretes allowing for… 4 3565 Very good points.
