I still haven't had a call from the builder but I've just spoken to my insurance who has walked me through what the next step is: i.e - submitting claim form. Re: Our Ashford Homes Build - the beginning... 43Oct 18, 2016 1:36 pm How awful, the least they can do is call their client and let them know and what do to do now. Glad to hear you've spoken to your insurance. I'd be a blubbering mess right now so you're doing better than me. Sending lots of cyber hugs hun!! QBCC is saying we need to seek legal advice to cancel our contract.. Can't cancel the contract without writing to Newstart which we can't do so frustrating! Haven't heard from liquidators and have been chasing them to find out how we can use our plans re copywriter issues. In ours it says that we can terminate the contract in writing if the company does an act of bankruptcy or comes under external administration. I would think a simple email to Newstart stating that you're exercising your right to terminate the contract should be enough. Hey there yes but as Newstart don't exist anymore to my knowledge they don't have a working email? We have sent an email to the liquidators but not heard anything back Re: Our Ashford Homes Build - the beginning... 56Oct 21, 2016 10:57 am Hi Ladybugs, as we are in VIC we called insurance VMIA and were told to lodge in a claim.. Haven't heard anything yet from liquidator..anyone knows the liquidator's contact? Re: Our Ashford Homes Build - the beginning... 57Oct 21, 2016 11:43 am We haven't had any contact either from anyone. We didn't get as far as insurance so aren't able to claim anything - but I'm assuming that since the company is no more that our contracts would be null and void anyway. We had sent an email to Homestead the week before the collapse but never heard back Re: Our Ashford Homes Build - the beginning... 59Oct 21, 2016 4:09 pm Thanks Party, this is great. Will contact them.. Re: Our Ashford Homes Build - the beginning... 60Oct 21, 2016 9:25 pm I called them today.. Again lol I warn you they are not very helpful over the phone and will just tell you to email to them to the Newstart customers address. they told me today they have put a statement on their website and to keep checking for updates, also they are mailing out instructions to everyone depending on what stage they were up to, but could take a while. I also thought the contract would be good to but in the contract it say in case of the builder loses its licence or goes into liquidation you we have to email them to end our contract. We have a quote with another builder now and ready to sign but can't until we know how to get out of this one and if we can use our plans.. She did say that they were also in the process of working out if they will sign over plans to ppl if they want them but not sure if she meant they will charge for them ? because its not being managed properly. Also "properly" is too broad and too subjective a term to be able to pinpoint a single event as not being managed properly.… 1 2729 of course there are legal avenues. You've already mentioned it. I guess when you talk to a builder who butters up everything to look very polished, you get to start believing… 8 2249 |
