Browse Forums Building A New House Re: Our Ashford Homes Build - the beginning... 61Oct 28, 2016 8:32 am Just received email from the liquidator. I am afraid I wont get my deposit back as I dont think I ever got a insurance certificate.. ..I might claim as an unsecured creditor.. bad luck..
Just read through the papers, anyone understand the remuneration part? Does it mean we need pay liquidator on top of the loss we've already had? Re: Our Ashford Homes Build - the beginning... 62Oct 28, 2016 8:47 am I feel really sorry for those who started building or paid deposit to these builders... I hope the issue will be resolved in your favour and you all are back on track soon... In all honesty this whole process is very confusing. Re: Our Ashford Homes Build - the beginning... 64Oct 28, 2016 2:59 pm Wollert_vic Just received email from the liquidator. From my understanding they are not refunding any money paid, but you can claim compensation for works not done. So if you paid the deposit but the builder never did preliminary works (engineers reports, council submissions, etc) you can claim that. As for remuneration of the liquidators I think it's just something they have to get passed at the meetings by creditors and customers, basically saying this is the job we are going to do and this is what we will be paid to do it. We've spoken to the liquidators and they told us to email them with a request for someone to call us back, then it will be directed to the right people. We're not claiming any losses, just want our plans released to us!! I hope everyone else affected gets a resolution soon too! Our Ashford Homes Build - the beginning... 65Oct 29, 2016 11:15 am So do we have to get permission to have the plans released even if they've started building? I'm in the process of getting quotes to have the build finished. The insurance has told me they will get one quote and for us to get the rest. I want the have everything ready so when our claim is settled we are ready to hit the ground and bloody get a roof on our house and frame wrapped before anymore damage is done! I've also organized the temp fencing. Our current one will be removed on Monday or Wednesday. I've been told this is claimable on insurance and I just need to sort out liability insurance (also claimable). Do I need to do anything else?? Sounds like you're on top of everything party of 5 - I really hope you are able to start building again asap, I've found it hard enough without any construction so I can only imagine how frustrating this must be for you I wouldn't think that you'd need the release of plans as yours has already started, it probably comes under part of the insurance - my issue is that no other builder will take the risk building our exact plans until we have clearance because we hadn't gone to site yet. Keep us updated how you're going! I'm sending good vibes out to everyone caught in this mess! Re: Our Ashford Homes Build - the beginning... 67Oct 29, 2016 1:54 pm Thanks Girlie! Hope you get those plans released! Re: Our Ashford Homes Build - the beginning... 68Oct 30, 2016 8:58 am We are having the same problem, our new builder won't risk building our plan until we can prove that the liquidators will let us have them, so we are booked in with a draftsman on Tuesday to try and design one of the plans as similar as our as we can. I haven't recieved the email yet.. Do they mention the plans in there at all? Our Ashford Homes Build - the beginning... 69Oct 31, 2016 6:06 am Ladybugs2 I haven't recieved the email yet.. Do they mention the plans in there at all? We haven't received any emails either. Just a lot of paper mail that's mainly about the creditors Re: Our Ashford Homes Build - the beginning... 70Oct 31, 2016 9:05 am Seems crazy to me that you have to get approval on the plans.. when you've already started building the house and the builder went under ;-; really feeling for you guys. Hope things get better quickly. Re: Our Ashford Homes Build - the beginning... 71Oct 31, 2016 5:28 pm Finally, our claim has moved to the "assessment" stage. Got a call today and was told that a building consultant is going out to our site on the 14th Nov. Got a call today and was told that a building consultant is going out to our site on the 14th Nov. That's great news! Hopefully there'll be lots of progress before they all go on holidays for xmas and you can look forward to some building action in the new year!! Have they given any indication of how long this process will take? Re: Our Ashford Homes Build - the beginning... 73Oct 31, 2016 6:24 pm Ladybugs2 I haven't recieved the email yet.. Do they mention the plans in there at all? Unfortunately no but we've had pretty good success in contacting the liquidators and they've been reasonably helpful. I would just keep phoning them. Re: Our Ashford Homes Build - the beginning... 76Nov 01, 2016 7:26 pm Thanks everyone! For the first time in a while I'm actually excited! According to the "indicative timeline" given by the insurers, it can take up to 45 business days from when the consultant goes out to the site to settlement. We're in the process of getting quotes now to complete the build so hopefully that helps reduce that time frame. I would love to get a roof on and house wrapped before the Xmas holiday period. Re: Our Ashford Homes Build - the beginning... 77Nov 02, 2016 3:23 pm Not sure about the floor plan release things...i guess we can get answered tomorrow in the creditors meeting? Re: Our Ashford Homes Build - the beginning... 78Nov 02, 2016 6:41 pm Good luck for the building inspector stage! Fingers crossed it all goes smoothly for you!! It would be fantastic to get builders on to it before Christmas! of course there are legal avenues. You've already mentioned it. Sue them. I find it odd that lawyers wouldnt be willing to take on the case, given CCT evidence and… 1 23764 Thank you so much everyone. This all makes a lot of sense. I guess when you talk to a builder who butters up everything to look very polished, you get to start believing… 7 17581 3 48350 |
