Anyway, I was contacted by the people who own the block next door, they are finally ready to build. They want access to our property by pulling four panels of the fence down to build their garage on the boundary I guess. My question is, is that even legal for them to just assume we can go without a fence for up to 3 months? (That is what the builder told them it would be down for) and we have had all our paving etc done down that side right to the fence line (dead side) what if they destroy it? Also we have a very large dog!!!! I mean I want them to get their house built, but do I really need to be inconvenienced by this? Remember they are going to be your neighbours, plus it's also their fence. If they take it down they need to replace it. Including any damage. If they damage it they should replace it. Once completed the wall of their garage would be the fence and the paving should be reinstated. I think it is in your best interest to allow access as if the motor is not finished as face brick you will be looking at a$hitty wall. I have two boundary walls and agreed colours and finish with both neighbours. I dont think I should just allow access without them offering some form of compensation for any thing that may get destroyed, also I still cannot agree to up to 3 months without a fence with the dog, and a temp fence she will just dig under or it will just blow over in the wind as they do! Ask for evidence of the builders insurance coverage and written confirmation that any and all damage caused by removal of the fence and any transit through your property will be repaired to original condition. 2. Specify the quality of the temporary fencing to keep your dog safe although tell them that it's for their protection from your dog. 3. Tell them they must give you a written undertaking that if because the fence you put up has been removed and the dog does bite anyone using your property as access then there will be no action taken against you and your dog. I like the bobcat idea - not too dear to hire either. Before doing that, maybe advise them you intend having all their stuff moved in the next 48 hours.
