We are wanting to build a duplex on a sloping triangle block and it seems like a PRE DA will give us at least a bit of a feel for whether council will let us bend some rules, like front setback. Does a Pre DA give us any real feel? Or do we really need to do the full DA? Have quotes ranging from 1000 to 6000 from different Builders and draftsmen, including Vogue Homes, Zac Homes, Champion homes, and a few draftsmen, who can take us to Pre Da and sketched up designs and a site map, but we still don't know if this will then give us a real idea of what is allowed. Thanks Re: Pre DA what does it really tell you likely with Vogue ho 2May 17, 2016 2:32 pm As someone who draws plans for a living I can tell you that most councils and their staff are pretty non-committal when it comes to anything outside their guidelines. All they will do is quote you section 4.2.3 of their LEP or DCP - max building ht 8.5m , min side setback 900mm etc etc - no ifs buts or maybes. One of my clients wanted to do a pre-lodgment meeting with our council against my advice and I told him the areas in his proposed DA that were bending the rules - some by a lot, some a little. $600 later plus what I charged him for my time and the council told us exactly what I told him before. Front setbacks, total heights etc are pretty much set in stone. Other things like side boundary envelopes, shadowing of neighbouring properties, they give you a bit more leeway. A good draftie or building designer who is familiar with your council should know all this anyway. If you are trying to get something through that doesn't comply with their guidelines then you can always try getting it through via Clause 20 which basically means that every site is unique with its own features and limitations. The councils recognise this and that their rules can't always be applied to every site. You should mention this in your SEE but you also have to have a pretty strong argument as to why you can't comply.
