I am in a situation... Hoping someone could give me ideas. Apologies for a very lengthy post...
My builder sent me fixing stage invoice on the 2nd of February and verbally told me that he will complete the build around 1st week of April and try to handover before that if possible.
I was going to be away for the whole of April (I told him about this when I met him in Feb) and I requested him to push the dates to end of April when I didn't hear from him about the completion by mid March, which he was not so happy about and the conversation went a bit south as he was saying I need to pay while I'm away. Finally he agreed that the house will be handed over at the end of April and he will slow down enough so that he delays it by two weeks for me to be back.
When I came back from holiday he was way behind and told me that he was held by suppliers and there is nothing he could do. Then he came back and advised that the handover will be on the 23rd May @ 4:30. He wouldn't agree for pci until the handover day or face another 10 days delay after pci. I then told him that I'm OK for the delayed handover and asked him to organise pci inspection, but he won't agree on an inspection time before 4:30 pm and the inspection company won't book an appointment later than 2:30 pm. He says he can give an appointment a week after (if I need 2:30 pm appointment) and then handover after 10 days.
He is behaving smart as he is still within signed contractual dates. Please give me ideas to handle this situation. Should I just accept that it is what it is and face the delays or should I talk to vcat/lawyer?
